The Terms and Conditions Boss Capital Group have issued may be amended at any time by us, and the amended Conditions will be effective from the date posted on our website

“Client” means the "the Buyer" "the Seller" whose details are provided
"Goods" means the “Businesses for sale”, or generally any product or service offered through the website.

"Services" means “advertising online” to allow people to sell their 'business(s)' to people advertising to buy a 'business'

1. ACCEPTANCE FOR TERMS AND CONDITIONS

Subject to clause 5 of these terms and conditions, the company will NOT accept responsibility for any loss or Damage you may suffer whilst using the website www.bosscapitalgroup.com.au

The company has not personally inspected any of the 'goods' offered by clients, and the company does not accept any responsibility nor liability for any claims, to include costs, damages, expenses, losses arising whether direct or indirect.  The company provides the facilities to allow clients to advertise their goods without any contribution to the details entered and submitted. The client needs to ensure they conduct their own due diligence before making a purchase of Goods.

The company does not offer advice in the purchase or valuation of the business, you the client must seek to ensure you have investigated the business before commencing a purchase of the advertised business. We recommend seeking professional advice before purchasing of a business.  The company neither does nor offer accounting or legal advice.

1.1 By registering information and using our website, you the client signify acceptance of our Terms and Conditions and certify that all information you supply to us will be;
1.1.1 truthful;
1.1.2 not be unlawful;

1.1.3 infringe on rights of any third parties; and
1.1.4 not cause damage to any property

1.2 You the client are to agree to indemnify the company ‘Boss Capital Group’ against all claims proceedings, costs and damages (including damages or compensation paid on legal advice) and all other legal costs and other expenses in connection with a breach of these Conditions by you the client.

2. TERMS AND CONDITIONS OF USE:

2.1 by using this website, you are agreeing to be bound by our terms and conditions as set out here. This website complies with Australian Law.

2.2 The company website has been created to allow potential buyers of businesses to contact sellers of businesses. The website must not be used in an unsolicited way to contact people that are advertising or making their details readily available through the company

3. TERMS OF SERVICE

3.1 The company offers the use of its website for the purposes of Advertising only, to allow you the ‘client’ to advertise or look for business opportunities.

3.2 If you are selling a good or goods though the company website, you can only do so by agreeing to these terms and conditions.  All users of the website need to agree to the terms and conditions in order to use the services offered.

3.3 The company retains the right to refuse improper or fraudulent goods or services used by you.  The company has the wright to remove such goods or services within 72 hours.

3.4 You will certify any details you the client submit for the service offered will be completed to the best of your knowledge.  The client also agrees to indemnify the company of any claims or losses it may incur on the use of the website.

3.6 The company may edit details of any information submitted by you ‘client’ on the website for purposes of assisting the sale goods. 

3.7 If you selling a business as an agent, broker or any form of an intermediately, you must agree to the following and by promoting good(s) through our website, you are bound as a user to the following;

3.7.1 You the client warrant and undertake that you have full permission to promote goods on behalf of the owner(s) goods.

3.8 If you are a buyer you agree to be bound by these terms and conditions.  Before making purchase decisions please consult with a professional. 

3.9 You the client agree to indemnify the company against any claims, costs, losses, expenses or damages arising whether from direct or indirect as a result of your use with this website

3.10 All fees for Services offered is specified on the company website.

4. PAYMENTS AND REFUNDS

4.1 Payment is to be made online using either MasterCard or Visa cards.  All payments is secured through a 128 Bit encryption key. Once payment has been received, Boss Capital Group will appear on your payment card statement.

4.2 The company does not offer refunds.  The company may consider refunds in the event the Services offered have not been fulfilled.  The refund will be paid into your original payment card.  This can only be achieved once notice is received from you, and only before we have supplied the relevant Service. Notice of cancellation must be sent via email to accounts@bosscapitalgroup.com.au

4.4 All payments a charged to you the client in Australian Dollars.

5. LIMITATION OF LIABILITY

5.1 The company does not certify the successful sale of your good(s).

5.2 You the client agree the company shall not be liable for any of the following unless caused by a failure on our part to take reasonable care:

5.3.1 Delays in receiving or sending communications

5.3.2 damages caused to property through malicious spam or viruses

5.3.3 Any unlawful access to your data or financial accounts or personal details

5.4 Subject to the above terms, any liability compensation shall not exceed the total fees already paid to us and be limited to a maximum of 12 months.

6.1 Businesses for Sale, listed (advertised) on our web site are neither offers nor recommendations by Boss Capital Group Pty Ltd.   We only provide advertising services for interested business owners and agents who list their business for sale.  The businesses for sale listings on our website www.bosscapitalgroup.com.au are advertisements listed directly by business owners or agents representing business owners.  We have not verified the accuracy of the information and are not responsible for any errors in the listings.
